This Agreement is a public offer in accordance with Art. 633, 641, 642 of Chapter 53 of the Civil Code of Ukraine and is the equivalent of an "oral agreement", and in accordance with the current legislation of Ukraine has the appropriate legal force.

A carrier that is registered and operates in accordance with the requirements of the State where transportation is carried out, from one Party, and

The client (individual or legal entity) who orders and pays for the service of passenger transportation (including luggage), including for the benefit of a third party, on the other hand, has concluded a Public Offer Agreement (hereinafter the Agreement) on the following:


SUBJECT OF AGREEMENT


Based on this Agreement, the Carrier undertakes to provide transportation services for the Client and his luggage (hereinafter the Service), according to the route, date and time of departure chosen by the Client, and the Client undertakes to pay for the Service in advance.

The waybill issued to the Client is an integral part of this Agreement, and is a certificate of the conclusion of the Agreement and Contract of carriage between the Carrier and the Client.

The passenger's Itinerary number is generated by the PC and is a unique number of the Agreement.

The waybill does not give the right to use the Service, but is subject to exchange by the Carrier for a ticket or boarding pass.

The term of acceptance of a public offer is not limited.


RIGHTS AND OBLIGATIONS OF THE PARTIES


Rights of the carrier:


change the terms of service provision, including re-registration or refund for unused transportation, having previously placed the information in the PC;


Obligations of the carrier:


provide the Service according to the selected Route;

in case of cancellation or change of the terms of provision of the Service, to return the funds received as an advance payment to the Client;

to provide advice on issues arising from the Client regarding the use of the Services: placing an order, conditions for reissuing and returning the Itinerary;

maintain the confidentiality of information received from the Client;

to acquaint the Client with the Rules of Passenger Transportation and the conditions for ordering, reissuing and returning the passenger's Itinerary;

exchange the Itinerary for a ticket or boarding pass.



Customer rights:

Get advice on issues arising from the use of the Services: placing an order, conditions for reissuing and returning the passenger's Itinerary;



Obligations of the Client:

pay for the Service;

provide reliable information necessary for placing an order;

require confidentiality in relation to the information provided at the time of advance payment;

provide documents certifying the Client's identity when exchanging the Itinerary for a ticket or boarding pass.


TERMS AND PROCEDURE OF PAYMENT


The Client pays for the Carrier's services by 100% prepayment in cash or by non-cash payment, bank card.

The price of the Service is formed from the price of the actual cost of the service, the tariff, fees and taxes, taking into account the remuneration of the third party participating in the conclusion of this Agreement, and is indicated in the passenger's Itinerary.


PERIOD OF SERVICE PROVISION


The route, date, time of departure and arrival are displayed in the Itinerary.

The fact of the end of the service is arrival at the final destination specified in the Itinerary.


RESPONSIBILITY OF THE PARTIES


The carrier is responsible for:

provision of services to the Client;

delay and/or cancellation, and/or postponement, changes in the terms of service provision;

level of service on its flights.

The client is responsible for:

provision of unreliable data when registering the Service;

for issuing the necessary documents (visa, etc.) for crossing the borders of other states.

Exemption from liability of the Carrier:

for deviations from the schedule, untimely delivery of the vehicle, which arose as a result of force majeure circumstances (including, but not limited to: weather conditions, traffic jams ("traffic jams") on the roads, actions of state authorities, etc., as well as the actions of the passengers themselves, which affect the fulfillment of obligations) or other circumstances (technical malfunctions of the bus on the way to the place of departure), which the Carrier, despite the measures taken, could not foresee and prevent them;

for expenses incurred by the passenger as a result of late arrival at the destination;

for any damages incurred by the passenger as a result of the criminal activity of any private person (including other passengers, road users or crew);

if the passenger has problems with state authorities in connection with documents (passport, visas, insurance, etc.) or the contents of the passenger's luggage;

for things left or forgotten in the bus cabin;


SETTLEMENT OF DISPUTES


The parties will settle through negotiations any controversial issues, disagreements or claims that may arise with respect to this Agreement or in connection with its performance.

All controversial issues are considered in the presence of a written statement sent by mail or fax. The pre-trial dispute settlement procedure is mandatory.

In the event that the Parties cannot reach an agreement on controversial issues through negotiations, these issues shall be resolved in accordance with the current legislation of Ukraine.


FINAL PROVISIONS


On all issues not regulated in the text of this Agreement, the Parties are governed by the current legislation of Ukraine.

In case of changes to this Agreement, its suspension, termination of its validity, the Carrier is obliged to provide the Client with all services that were paid for.

Each Party guarantees to the other Party that it has the necessary legal capacity, as well as all the rights and powers necessary and sufficient for the conclusion and execution of the Agreement in accordance with its terms.
